Pre-pay contract moratorium law effective July 1

From July 10: On July 1, a new law concerning pre-pay contracts went into effect. The passage of this law was in response to the Ace Oil closure last fall that resulted in hundreds of customers losing a total of $1.5 million in prepay contract money.

HOD's fined for failure to comply with advertising regulations

From Nov. 28: Registered Heating Oil Dealers (HOD) are required by law to display the HOD number on all advertisements. Advertisements are considered to be any and all places that your company name is displayed. They include delivery tickets, Yellow Page ads, web sites, billboards, trucks, newspaper ads and business cards, just to name a few.

Guaranty fund bill killed

From March 20: Recently, the General Law Committee Chairs (Sen. Paul Doyle, Rocky Hill and Rep. David Baram, Bloomfeild) killed two bills that CEMA and our friends at PGANE have been working hard to defeat. The language in both bills (SB 299 & HB 5260) have been removed and replaced with some provisions offered by the industry as an alternative to the proposed guaranty fund/tax and the bonding requirement.

Feds issue alert on CT natural gas supply, prices

From Jan. 9: The extended cold weather forced the U.S. Energy Information Administration to issue an alert on the supply constraints and expected skyrocketing prices of natural gas in Connecticut and all of the Northeast. Because of the extended cold weather, natural gas demand rose 8 percent in New England and 2 percent in New York. Because the pipelines feeding natural gas into the region from the west and the south have been constrained, EIA says Connecticut and its surrounding states should expect nearly a tripling in prices.

Guaranty fund/oil tax hearing next week

From March 6: It is likely that a public hearing will be held March 11, in Hartford on a bill that would require all registered heating oil dealers to pay into a guaranty fund, so that prepay contract customers could be made whole in the event that heating oil dealers were to close without fully honoring the contract. The new tax would apply to all propane and heating oil dealers regardless of whether you sell prepay contracts or not.

Nat gas expansion in Connecticut faltering

From June 26: The state's three natural gas utilities have asked the Connecticut Public Utility Regulatory Authority to open a new docket to reconsider modifying protections that are in place to shield ratepayers from uneconomic natural gas line expansion projects. Since the approval of Governor Malloy’s energy plan that calls for the construction of 900 miles of new gas lines throughout the state – little progress has been made in accomplishing that goal.

29 HOD's fail to respond to DCP audit

From Nov. 28: Last month, heating oil and propane dealers received an audit form for the Department of Consumer Protection (DCP) that was required to be filled out, notarized and returned by Nov. 14. Prior to the deadline CEMA called over 100 dealers to help them get in compliance before the deadline. 29 HOD’s ultimately failed to respond to the audit and are subject to $500 fines.

Confronting Yankee Gas in Fairfield County

From Feb. 6: Yankee Gas made a presentation Jan. 28, in Wilton about potential plans for natural gas expansion. CEMA was there to challenge their statements and provide information to some 30 town residents who attended the meeting. As with New Canaan last fall, town government was very supportive of the utility's plans and we were not allowed to make a public statement. Nevertheless, we believe our "guerilla marketing" was effective in making some people think twice about the rosy story being told by the gas company.

Legislature considering changes to prepay heating oil contract law

From Feb. 20: The legislatures General Law Committee has raised two concept bills dealing with prepay contracts. The title of these bills are An Act Amending the Fuel Supply Business and Heating Fuel Statutes and An Act Establishing a Prepaid Consumer Oil Contract Guaranty Fund. This legislation does not have any language as of yet, but we believe that AA Amending the Fuel Supply Business and Heating Fuel Statutes will repeal the requirement that contracts be secured with a futures contract, and replace it with a requirement to have a bond.

Tom Foley says 'no' to natural gas buildout
CEMA
From Oct. 16: In a recent interview by the Connecticut Mirror, Republican candidate for Governor, Tom Foley, was quoted as saying that he gives an unequivocal “no” to whether he supports the natural gas expansion being pushed by Governor Dannell Malloy. "He’s burdening consumers’ home heating fuel with the cost of the buildout for natural gas."
