Legislation Alert
With the DOL overtime rule now finalized and due to take effect Dec. 1, ASAE has turned its focus toward a possible legislation solution in Congress. A bill introduced last week by Rep. Kurt Schrader (D-OR) titled The Overtime Reform and Enhancement Act (OREA) would incrementally phase in the new salary threshold over the next three years to give businesses adequate time to adjust to the new standard while also ensuring workers are fairly compensated. The bill would also eliminate a provision in the final overtime rule that allows for automatic updates to the salary threshold every three years.
While Republican bills have gained traction, this bill is widely viewed as a reasonable compromise that can potentially win bipartisan support. ASAE encourages our members who share our concern about the overtime rule to send a letter of support. ASAE’s letter can be found here. Feel free to use this letter as a model for your own comments. As you know, ASAE has contended in public comments to the Labor Department that the $47,476 salary threshold for overtime eligibility amounts to a “one-size-fits-all” solution and that the minimum salary level for exempt employees should instead be keyed to government data on regional cost-of-living differences. ASAE is concerned the new rule would adversely affect many nonprofit organizations and other employers with limited revenues, and could harm many affected employees as well.
