Legislation would protect electronic content from government access

NAA signed onto a coalition letter in support of legislation the Senate Judiciary Committee is expected to consider on Thursday that would protect personal content held by service providers. The bill, sponsored by Sen. Patrick Leahy, D-Vt., would reform the Electronic Communications Privacy Act to require law enforcement agencies to obtain a warrant based on probable cause (except in emergencies or under other existing exceptions) in order to compel a service provider to hand over personal communications such as emails, texts and documents stored in "the cloud." The bill would implement the first principle that is supported by the Digital Due Process coalition, which advocates for ECPA reform and of which NAA is a member. Current law allows the government to access electronic content under less stringent standards. NAA supports the ECPA reform effort because so much newsgathering now happens by electronic means.
