DHS Publishes Advance Notice of Proposed Rulemaking to Streamline CFATS
The U.S. Department of Homeland Security (DHS) is seeking comment submissions that will help identify ways to make its Chemical Facility Anti-Terrorism Standards (CFATS) program more effective in achieving its regulatory objectives.
California Air Resources Board (CARB) to Survey Architectural and Industrial Maintenance (AIM) Coatings, Consumer and Commercial Products, and Aerosol Coatings
The surveys will require manufacturers’ and suppliers’ participation in a multi-year data collection, whereby sales and product ingredient data, including information on volatile organic
compound (VOC) content, will be required.

OSHA Seeks Additional Information on Proposed Rule for Improved Tracking of Workplace Injury and Illnesses
During public meetings and in the comments submitted, many participants expressed concern that the proposal might create the incentive for employers to under-report injuries and
illnesses, since each covered establishment’s injury and illness data would become publicly
available on a new OSHA website. OSHA seeks information on the costs and benefits of using the rulemaking to address the issue of employers who discourage employees from reporting injuries and illnesses and how OSHA can clarify existing protections for employees from potential employer discrimination.
Health Canada Issues Revised Hazardous Products Regulations
The Hazardous Products Regulations will replace Canada’s Controlled Products Regulations (CPR), and will implement the United Nations’ Globally Harmonized System (GHS) for the Classification and Labeling of Hazardous Chemicals in Canada.
Chemical Distributor Inventories Approach $13 Billion, While Sales Exceed $11 Billion

Chemical distributors are a key component of the chemical industry supply chain, providing a key sales channel for chemical manufacturers as well as holding substantial inventories of chemicals. The Census Bureau tracks these businesses in its Monthly Wholesale Trade Survey (MWTS), which provides national estimates of monthly sales, end-of-month inventories, and inventories-to-sales ratios by kind of business for wholesale firms located in the United States. Specifically, the MWTS covers wholesale merchants who sell goods on their own account and include such businesses as wholesale merchants or jobbers, industrial distributors, exporters, and importers. The Census report does not include sales offices and branches maintained by manufacturing, refining, or mining firms for the purpose of marketing their own products.
Merchant wholesalers of chemicals and allied products sold $11 Billion of product in the most recent month of reporting (on an annualized, seasonally adjusted basis). As shown above, they typically hold in inventory between 1.1 and 1.2 that amount (in June, inventory levels reached nearly $13 Billion). The inventory/sales ratio has typically stayed in that range except during the 2008-09 recession period, when sales fell sharply between August 2008 and March 2009, while inventory holdings declined much less precipitously, with inventory/sales ratios rising as high as 1.33 in March 2009. Increasing sales and continued inventory reductions in the second half of 2009 brought rations back into line with historical norms.
