The Texas Association of Builders has updated the 2015–2017 contracts package. Additions include:
- New Architect/Design Professional Addendum to protect the builder when the owner hires an architect or design professional.
- New landscaping warranty exclusions in all construction/remodeling contracts, and content damage provisions in all remodeling contracts.
- The addition of a new "plan design release fee" to the existing Design-Build Agreement.
If you have already purchased the contracts, you can go online to download the new additions. If you still need to purchase the contracts, you may do so here. The $399.99 subscription includes any updates that may occur during the two year cycle.

In what might be the most expensive callback in the history of home building, a Montana jury has decided that a builder and plumbing contractor must pay almost $1.75 million to a homeowner after a drainage system they installed caused damage to the foundation of her home. As reported by the Billings Gazette, Oakland Home Builders Corporation and Treasure State Plumbing and Heating must pay $240,000 in damages for breach of contract, negligence and personal injury plus $1.5 million in punitive damages.

Yes, it is true that home prices, on average in 20 major metropolitan areas are above the 2007 peak. It is also true that specific, highly populated cities with limited supplies of new and existing homes are experiencing "surge pricing" amid strong demand.
In fact, pending home sales expanded in most of the country in July and reached their second highest reading in over a decade, according to the National Association of Realtors. Only the Midwest saw a dip in contract activity last month.
