Notice of Passing: William 'Bil' Kennedy
PHTA is mourning the loss of William "Bil" Kennedy, Founder of P.K. Data, Inc. Kennedy passed away at the end of 2020. He was the leading expert in market research for the pool and hot tub industry and did great work for the industry for almost 30 years. P.K. Data has been an incredible partner to PHTA, creating our annual Market Report and Economic Impact Study. Kennedy will be missed by his family, friends, and the countless individuals throughout the industry who worked with him.

Outdoor Space as Art

GENESIS® D265: Master Designer Methods: Kirk Bianchi, Crafting the Outdoor Space as a Living Art Form is now open for registration. As part of the new GENESIS® Master Designer Methods series, Bianchi will retrain your thinking of water vessel design. "The pool is often built first in the sequence of outdoor improvements. For the best integration, however, it should actually be designed last." Bianchi's method will require students to rethink their design approach, with a landscape-based process that considers the functionality of the entire space first. The course lecture and projects will focus on sightlines, living spaces, traffic flow, spatial considerations, and more. This course takes place on February 9, 11, 15, and 17 from 7-10pm ET.

PHTA and ICC Present the International Swimming Pool & Spa Code
The International Swimming Pool & Spa Code (ISPSC) is a comprehensive pool and spa code concentrating on all aspects of pool and spa design and construction. The code addresses quality, safety, energy, and conservation. Built upon national consensus, the code is ANSI/APSP approved standards.
On February 16 and 18, PHTA is offering a virtual ISPSC training for a wide range of industry professionals: architects, engineers, building inspectors, building officials, contractors, plans examiners, plumbing inspectors, and pool and spa installers. Upon completion of the course, and meeting jurisdiction requirements, attendees may qualify as a third-party inspector.
If you are unable to attend in February, a second training will be held on April 19 and 21.

.STANDARDS AND CODES
Seeking PHTA Glossary Committee Members
The Pool & Hot Tub Alliance (PHTA) seeks participants to serve as voting members on the PHTA Glossary Committee. The committee, led by Jeff McGalliard of JMK Associates Inc., is responsible for reviewing and approving all terms and definitions used in PHTA's published standards. The committee will also consider terms and proposed definitions that are new to the industry or not currently defined within PHTA's existing American National Standards Institute (ANSI) approved standards. Get involved today and make a difference in the industry by applying to serve on the Glossary Committee. PHTA-2 Standard Writing Committee (SWC) Kick Off Meeting
On February 4, 2021, the official PHTA-2 SWC will met to review and discuss the newly proposed draft Standard for Public Pool and Spa Operations and Maintenance developed by a drafting committee comprised of PHTA Commercial Council members. PHTA-2 SWC Chair Dennis Berkshire of Aquatic Design Group will lead the discussion on the standard which is intended to cover public/commercial aquatic venues operation and maintenance. It can be used by state and local authorities as a health and safety code for the operation and maintenance of all types of public aquatic venues. Industry partners such as commercial pool and spa service companies, water park operators and public pool operators can also use this standard as the benchmark for the minimum standards to operate and maintain public aquatic venues. PHTA-2 replaces NSPI-2 1999 Standard for Public Spas. To learn how to get involved, please contact standards@phta.org.

Federal Update
Immigration Executive Orders. President Biden plans to rescind strict limits on legal immigration. The President plans to sign an executive order rescinding the proclamation that suspended certain immigrant and work visas.
Less than a month before President Biden took office, President Trump ordered a three-month extension of the restrictions, which were first enacted in April 2020.
The restrictions halted the issuance of several temporary visas used by people to work in the U.S., including the H-1B program that is popular in the tech sector and H-2B visas for non-agricultural seasonal workers, which PHTA member companies utilize. Cultural exchange J-1 visas for au pairs and other short-term workers such as summer lifeguards, visas for spouses of H-1B and H-2B holders, and L visas for companies to relocate employees to the U.S. have also been restricted.
PHTA's J-1 Summer Work Travel and H-2B Coalition continues to monitor and engage, where appropriate, on immigration matters coming out of the new Administration. PHTA is also taking part in coalitions with other industries who utilize the H-2B or J-1 SWT visas.

Legislative Updates
Hawaii: A hearing was held in the House Energy and Environment Protection Committee for House Bill 116 which modifies the rulemaking authority of the Department of Business, Economic Development, and Tourism and Chief Energy Officer and establishes appliance efficiency standards for air purifiers and portable electric spas. Portable electric spas must meet the requirements of the American National Standard for Portable Electric Spa Energy Efficiency ANSI/APSP/ICC 14-2019. The bill is sponsored by the Chairman of the Committee. PHTA supports this legislation and submitted written testimony in support of the bill prior to the hearing. Status: Hearing held on 2/2/2021.
Maryland: The hearing for SB 254 (ISPSC Adoption) was heard in the Senate Judicial Proceedings Committee on February 3. Jason Davidson, PHTA Director of Government Relations, provided oral testimony in support on behalf of PHTA before the committee. Video of the hearing will be shared in the February 10 PHTA e-newsletter. Status: Hearing held on 2/3/2021.
Maryland: Senate Bill 418 establishes certain energy efficiency standards through the adoption of regulations providing for energy efficiency requirements for a number of appliances used by the citizens of Maryland. In regard to portable spa provisions in this bill, PHTA successfully lobbied the Maryland Energy Administration to incorporate amendments requiring portable spas to meet the latest edition of the ANSI/APSP/ICC-14 Standard for Portable Electric Spa Energy Efficiency. The amendments will be introduced at the bill hearing. PHTA has submitted written supporting testimony for the amendments. Status: Hearing on 2/10/2021.
Montana: Senate Bill 152 would allow the Department of Public Health and Human Services to adopt rules relating to the licensing of operators of public swimming pools and bathing places. The measure would allow the Department’s rules to allow for CPR training, pool operator certification, and lifeguarding training to be conducted in person, online, or by other virtual methods. PHTA supports this legislation. Historically, Montana has resisted online CPO training. PHTA is actively seeking to engage with the sponsor to offer supporting testimony. Status: Hearing on 2/10/2021.
New York: Senate Bill 959 would allocate funds for swimming education in a public school. The commissioner would establish a working group who will carry out the study. The report must be submitted to the legislature and include their findings and recommendations reporting on swimming education in a public school. PHTA supports this legislation and is actively attempting to be amended into the bill as a member of the workgroup that would be established. Status: Introduced on 1/5/2021.
