EPA is proposing to set user fees applicable to anybody required to submit information to EPA under the Toxic Substances Control Act (TSCA). TSCA requires companies that manufacture (including import), distribute in commerce, or process a chemical substance (or any combination of such activities) to submit information to EPA under TSCA sections 4 or 5, and under TSCA section 6(b) if they manufacture a chemical substance that is the subject of a TSCA risk evaluation.

EPA is required to conduct a Residual Risk and Technology Review for each Maximum Achievable Control Technology (MACT) standard for Hazard Air Pollutant (HAP) at major source coating application facilities eight years after promulgation of the standard. EPA is currently in the RTR process for several MACT standards.

In its comments, ACA noted the Ohio Environmental Protection Agency’s (EPA) December 2017 adoption of universal waste rules allowing hazardous non-empty aerosol containers, hazardous antifreeze, and hazardous paint and hazardous paint-related wastes to be classified and managed as universal waste. ACA is urging that classification to facilitate and promote proper handling, recycling, and disposal of hazardous waste throughout the state.
