PHMSA Issuing COVID-19 Emergency Special Permits
In support of the critical need to move hazardous materials during the COVID-19 pandemic, The U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) is issuing hazmat emergency special permits to entities seeking exemptions from specific requirements within the Hazardous Materials Regulations (HMR). These special permits are necessary in helping to prevent the spread of COVID-19, as well as for response and remediation efforts associated with the current emergency.

CSB Publishes Accidental Chemical Release Reporting Final Rule
The Chemical Safety and Hazard Investigation Board (CSB) recently published a final rule on accidental release reporting (40 C.F.R. Part 1604). The final rule requires owners or operators of a stationary source to report any accidental release of an extremely hazardous substance into the ambient air that results in a fatality, serious injury, or substantial property damage promptly to CSB (as well as relevant government agencies, including U.S. EPA under RMP). An accidental release is defined as an unanticipated emission of a regulated substance or other extremely hazardous substance into the ambient air from a stationary source. The rule went into effect on March 23, 2020.
