The Supreme Court of Canada ruled last week that requesting someone's Internet data constitutes a search, and therefore requires a warrant. This Ctrl+Alt+Del'd a bill moving through parliament that would have let everyone from crack-smoking mayors to crack-smoking fisheries officers track citizens' Internet use without a warrant.

As the Canada Day deadline for a new anti-spam law nears, you may have noticed your email inbox filling up with messages from companies requesting permission to continue sending you marketing messages. According to one legal expert, the new law marks a turning point on how Canadian companies can communicate with their clients.
Starting July 1, a major section of a Bill C-28 will come into effect, governing the ways businesses and organizations can communicate electronically with clients, and how clients' personal information can be used for marketing purposes.

CRTC makes registered numbers on the National Do Not Call List (DNCL) permanent

The CRTC announced today that the numbers registered with the National Do Not Call List (DNCL) are now permanent. Canadians were previously informed that they would need to re-register their numbers at some point in time, but this move "enhances the CRTC's ability to protect the privacy of Canadians from unwanted telemarketing calls."
The DNCL was created in 2008 with a goal for Canadians to register their home phone, wireless, fax or VoIP telephone numbers to prevent annoying telemarketers from calling.

Police in the U.S. must have a warrant before they search an arrested person's cellphone, the U.S. Supreme Court ruled Wednesday in a decision observers say "bodes well" for a forthcoming ruling on digital search and seizure from Canada's top court.
The unanimous ruling, heralded as a huge win for 21st-century privacy rights, acknowledges the contents of a cellphone need far more privacy protection than the U.S. law currently provides, says the lawyer who is fighting this same battle before the Supreme Court of Canada.
